The “I Am Iconik” Loyalty Program

Starting this month, we want to give back to the people who have trusted us and have taken us along for the ride. We are happy to launch our “I Am Iconik” Loyalty program as a gift to our Iconik clients. 

Through the “I Am Iconik” Loyalty program, Iconik clients can earn points and various rewards and prizes as you take us in your every family and company trip. Read the terms and conditions below to know more!

“I AM ICONIK” LOYALTY PROGRAM – TERMS AND CONDITIONS 

Iconik Travels and Events (“Iconik”) is a sole proprietorship registered with the Department of Trade and Industry and engaged in the business of a travel company. 

Iconik hereby establishes the “I Am Iconik” Loyalty Program (“Loyalty Program”), a point- and reward-earning system, effective July 1, 2019. These terms and conditions govern the collection and use of points and rewards, and supersede any and all prior representations made by Iconik relating to the Loyalty Program. For avoidance of doubt, it is hereby understood that the Loyalty Program is a unilateral offer made on the part of Iconik and that the Booking Customer, as defined hereunder, by signing freely and voluntarily on the space provided below, agrees to bound by these Terms and Conditions. 

All Trips booked with Iconik (“Iconik Trips”) to Palawan, Cebu, and Bohol (“Iconik Destinations”)
fall under any of the following two (2) categories:

1. “Personal Trips” is defined as a trip organized and paid in full by a natural person, without
the intervention and/or sponsorship of any company, organization, corporation,
partnership, employer, or similar entity.

2. “Official Corporate Trips”:

● is defined as a trip organized and paid in full by any company, organization,
corporation, partnership, employer, or similar entity, which entity has submitted to
Iconik proof of its Taxpayer Identification Number (“TIN”) and Bureau of Internal
Revenue (“BIR”) Certificate of Registration; and

● may fall under any of the following three (3) types:

“Meeting” is defined as any official corporate trip booking a venue and food at the minimum. In
the event that the booking includes accommodations, a trip is classified as a meeting if the
duration of stay lasts for one (1) night at a maximum.

“Incentive” is defined as any official corporate trip that has a purpose of teambuilding or reward-
giving to company employees. It includes a booking of venue, food, accommodations, and tours.

“Conference” is defined as any official corporate trip booking a venue, food, and two (2) nights
of accommodations at a minimum.

“Booking Customer” is defined as the person in whose name the Iconik Service, as defined
below, shall be rendered. A Booking Customer has provided Iconik with information on the
Booking Customer’s travel requirements (budget, travel dates, etc.), and preferred Iconik Service,
but has not yet paid for the Iconik Service in full.

“Booking Period” is defined as the inclusive dates during which the Iconik Service, as defined
below, shall be rendered by Iconik in favor of the Account Holder, as defined below.

“Iconik Service” is any product or service availed through Iconik. This includes any or a
combination of the following:

a. Hotel Accommodations
b. Tour Packages
c. Transportation Services
d. Venue
e. Food or Catering Services
f. Event Coordination
g. Workshop and/or Program Facilitators
h. Merchandise
i. Lights
j. Sound System / Equipment

“Account Holder” is defined as the person in whose name the Loyalty Points and/or Rewards,
as defined below, shall be awarded, provided that the said person: (1) is a Booking Customer; (2)
has availed of any Iconik Service; and (3) has paid in full the amount (“Contract Value”) for the
Iconik Service, as evidenced by the Booking Confirmation and the Statement of Account (“SOA”)
in the said person’s name. Each Account Holder is assigned a unique user number (“Account
Number”) to which all records, points, and rewards will be accumulated. An Account Holder who
booked a Personal Trip will be assigned a “Personal Account Number”. An Account Holder who
booked an Official Corporate Trip will be assigned a “Corporate Account Number”. In the event
that an Account Holder is a sole proprietor, his/her trips will likewise be classified as either a
Personal Trip or Official Corporate Trip, and will therefore merit a separate Personal Account
Number and a Corporate Account Number respectively.

In circumstances where a representative (“Authorized Representative”) makes the booking and
facilitates the payment for the Account Holder, the Loyalty Points and Rewards, as defined below,
will be awarded to the Account Holder and not to the Authorized Representative. Notwithstanding
the foregoing, if the Authorized Representative accomplishes certain actions that merit Loyalty
Points, as described below, then the Authorized Representative shall be awarded Loyalty Points
and assigned his/her own Account Number.

“Authorized Guest” is defined as the person who has availed of an Iconik Service but has not
necessarily provided the payment for the same and provided that his/her name has been included
in the Booking Confirmation and the SOA. If the Authorized Guest accomplishes certain actions
that merit Loyalty Points, as described below, then the Authorized Guest shall be awarded Loyalty
Points and assigned his/her own Account Number.

“Rewards” and “Loyalty Points” are awarded to an Account Holder, whether used for a Personal
Trip or Official Company Trip, provided that the conditions below for the said award are satisfied.

“Referred Guest” or “Referred Entity” is a person that has learned about Iconik through another
person who has previously availed of an Iconik Service.

“Iconik Travel Consultant” refers to the frontline personnel of Iconik. Any concern, question, or
any form of communication between Iconik and the Account Holder, Authorized Representative,
or Authorized Guest will be coursed through the Iconik Travel Consultant.

“Tour Package” refers to an organized itinerary, composed of two (2) or more tour sites or
attractions.

A “Tour Site” is defined as only one (1) tourist attraction.

The availment of any, all, or a combination of the foregoing Rewards shall be subject to the following terms and conditions, as may be applicable:

Free Lunch/Dinner

● The free lunch/dinner may be availed of only from a restaurant which is within an eight-kilometer (8-km) radius of the tour site or accommodation booked by the Account Holder (“Qualified Restaurant”).

● The Account Holder shall inform Iconik of the former’s preferred restaurant, if any, among the Qualified Restaurants, prior to the signing of the Booking Confirmation and the SOA.

● Iconik reserves the right to assign a different restaurant without prior notice in the event that the latter is unavailable or unfit to visit due to bad weather, force majeure, a threat to health and safety, or other similar reasons.

● Any amount spent beyond the Maximum Value shall be paid for by the Account Holder. Iconik shall not be liable for any charges beyond the Maximum Value. Room Upgrade

● The free room upgrade should be in the same accommodation booked by the Account Holder, as evidenced by the Booking Confirmation and SOA.

● Any amount spent beyond the Maximum Value for the room upgrade will be paid for by the Account Holder. Iconik shall not be liable for any charges beyond the Maximum Value. Additional Tour Site

● The Account Holder may choose the additional tour site from Iconik’s list of tour packages (Appendix A).

● Iconik reserves the right to assign a different tour site without prior notice in the event that the chosen tour site is unavailable or unfit to visit due to bad weather, force majeure, a threat to health and safety, or other similar reasons.

● Any amount spent beyond the Maximum Value during the tour will be paid for by the Account Holder. Iconik shall not be liable for any charges beyond the Maximum Value. General If the Account Holder refuses or fails to avail of any Reward, the same is forfeited and may no longer be availed of in any and all subsequent Trips of the Account Holder, provided that the Account Holder may avail of the Reward(s) applicable, if any, for the said subsequent Trips. The foregoing Rewards are not cumulative. The failure to qualify and/or avail of Reward(s) during a previous Trip shall not disqualify the Account Holder from qualifying for and/or availing of Reward(s) for a current or subsequent Trip.

The free meal would be served only in the venue where the event or meeting is held.

● If the attendees total at least thirty (30) individuals, the free meal would be served buffet style. If the attendees total twenty -nine (29) persons or below, the meal will be plated.

● Iconik shall have the sole discretion to select the caterer, restaurant, or meal provider. The Account Holder may, however, inform Iconik of its preferred caterer, restaurant, or meal provider prior to the signing of the Booking Confirmation and Statement of Account. In the event that Iconik chooses a different caterer, restaurant, or meal provider, it shall inform the Account Holder at least two (2) calendar days prior to the meeting or event.

● Any amount spent beyond P10,000.00 will be paid for by the Account Holder. Iconik will not be liable for any charges beyond P10,000.00.

It is hereby understood that the Rewards shall reset to the 2nd after the Account Holder has availed of, claimed, and/or was entitled to the 8th Reward and every seventh Reward thereafter, such that the following Bookings of the Account Holder shall be treated as the 2nd: 9th, 16th, 23rd, and so on.

It is hereby understood that the Rewards shall reset to the 2nd after the Account Holder has availed of, claimed, and/or was entitled to the 4th Reward and every third Reward thereafter, such that the following Bookings of the Account Holder shall be treated as the 2nd: 5th, 8th, 11th, and so on.

Account Holders, Authorized Representatives, and/or Authorized Guests are also eligible to collect Loyalty Points, regardless of the type of Iconik Trip availed (Personal or Official Corporate), by accomplishing any of the actions below.

● Within three (3) calendar days after the end of the Booking Period, an official feedback questionnaire (online form) would be sent to the Account Holder, Authorized Representative, or Authorized Guests’ email addresses. ● Iconik reserves the right to withdraw the awarded points if the person is proven to have unliked or unfollowed the social media accounts.

• If the Rewardee refuses or fails to avail of any Reward, the same is forfeited and may no longer be availed of in any and all subsequent Trips of the Rewardee, provided that the Account Holder may avail of the Reward(s) applicable, if any, for the said subsequent Trips.

• The foregoing Rewards are not cumulative. The failure to qualify and/or avail of Reward(s) during a previous Trip shall not disqualify the Account Holder from qualifying for and/or availing of Reward(s) for a current or subsequent Trip.

Account Holders, Authorized Representatives, and Authorized Guests should be at least 18 years old to participate in the loyalty program.

Iconik reserves the right to adjust Loyalty Points balance and reverse Rewards in cases of incomplete transactions, credit card fraud, duplicate or cancelled transactions, reversed transactions, bogus and suspicious social media account, and similar cases.

The undersigned hereby grants Iconik the right to email or send text messages to the former on matters including, but not limited to, referral educational messages, messages for redeemed products, warning messages, administrative messages, and promotional messages. The undersigned further understands that should the undersigned wish to stop receiving emails and/or text messages, then the undersigned must opt out of the same by sending a message to Iconik through email (info@iconiktravels.com) or through SMS (09088215282).

Iconik is not liable for damages or losses, if any, resulting from any person’s participation or inability to participate in the Loyalty Program, or any person’s reliance on or use of information, services, or merchandise provided on or through the Loyalty Program. Iconik is not responsible and assumes no liability for changes or discontinuances of service from providers which may affect Rewards or the accrual of Loyalty Points.

The right to use the Loyalty Points is non-transferable.

Account Numbers and/or Loyalty Points are non-transferable and are void if transferred. All of the Account Holder’s Loyalty Points will be forfeited immediately in the event of the former’s death, revocation of license, cancellation of registration, cessation of corporate status, and/or similar events.

Loyalty Points and/or Reward(s) may not be bartered or sold and are not convertible to cash.

Account Numbers and/or Loyalty Points are not property of the Account Holder, Authorized Representative, or Authorized Guest and are not transferable during or after the lifetime of the Account Holder, Authorized Representative, or Authorized Guest either by voluntary transfer or by operation of law.

These Terms and Conditions embody the full, entire, and complete agreement in relation to the Loyalty Program between Iconik and the undersigned and supersede all prior negotiations, proposals, and agreements (whether oral or written), if any, between Iconik and the undersigned concerning the Loyalty Program, and there are no representations, promises, inducements, or agreements, between Iconik and the undersigned which have not been embodied herein. These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of the Philippines and each of Iconik and the undersigned submits only to the jurisdiction of the courts of Puerto Princesa to the exclusion of all other courts.

No waiver of any right or provision under these Terms and Conditions may be claimed against Iconik unless it is in writing signed by Iconik. No delay or course of dealing by Iconik in exercising any right under these Terms and Conditions shall operate as a waiver thereof, and no waiver by Iconik of any such right shall preclude any further exercise of such right or of any other right under these Terms and Conditions.
